HP High Court Allows Plea Withdrawal Over Land Donated for Sihunta Government College
Shimla, October 13: The Himachal Pradesh High Court has permitted the withdrawal of a petition seeking the return of land donated for the construction of Government College, Sihunta, granting the petitioner liberty to approach the competent authority for the return of the land.
Justice Sandeep Sharma passed the order on a petition filed by Jafoo and another.
The Court noted that the Government College, Sihunta, had been constructed on land other than the land donated by the petitioner. In view of this, the petitioner sought permission to withdraw the petition, reserving the right to pursue the matter before the competent authority for the return of the donated land.
The High Court directed that any representation seeking the return of the land must be considered and decided by the competent authority in accordance with law.
The Court further asked the authority to take a decision expeditiously, preferably within three months from the date of receipt of the representation.
The order leaves the question of returning the donated land to be decided by the competent authority in accordance with the applicable law.
