High Court Himachal in Shimla

Shimla, June 19:  In a major relief to Dr. Pankaj Sharma, the Himachal Pradesh High Court has directed the State Government to issue a No Objection Certificate (NOC) and release his original MBBS degree, enabling him to join a Super Specialty course in Medical Oncology under the DNB SS program.

Justice Sandeep Sharma quashed the government’s rejection order dated May 26, 2025, observing that Dr. Sharma, currently serving at PJLNGMC Chamba, had already completed more than a year of service post his PG and met the policy requirements.

The State had denied NOC citing incomplete one-year field posting.

The court clarified that under the amended 2021 PG policy, doctors posted in new medical colleges are exempt from the one-year field posting rule.

It ruled that forcing someone to serve against their will, despite readiness to deposit bond money, was unjustified.

Dr. Sharma undertook to deposit ₹40 lakh within a week and return to serve the State for five years after completing his course.

The court warned that failure to honor the undertaking would attract contempt and forfeiture of the bond.
